Terms of Use for the "Moazez" Platform

Scope of Application: These terms apply to the "Moazez" platform, its applications, and services provided to schools, including: the Student App, Parent App, Teacher App, School Dashboard, the website, and any associated services or APIs.
1) Acceptance of These Terms
By using the "Moazez" platform or any of its services through your school/educational institution, you acknowledge that you have read, understood, and agree to be bound by these terms, the privacy policy, and any supplementary policies (such as the information security policy, and the refund/cancellation policy if applicable to the school).
If you do not agree to these terms, please do not use the platform.
2) Nature of the Relationship and Roles
- The school/educational institution is the primary contracting party with "Moazez" and is often the data controller and the authority in managing users, permissions, and content within the system.
- Users (students/parents/teachers/administration) obtain access only through the school and according to their permissions.
- Moazez provides the platform as a service (SaaS) and processes data according to the school's instructions and in compliance with relevant regulations.
3) Eligibility for Use and Minors
- The use of the platform may include minor students. The student's use falls under the school's framework and permissions, and as permitted by the parent/regulatory authorities according to applicable regulations and instructions.
- The parent is responsible for the confidentiality of their login credentials and monitoring their account activity within the limits of the platform.
4) Accounts and Login Data
- The school creates user accounts or links them to its systems.
- Correct and updated information must be provided.
- You are responsible for: maintaining the confidentiality of your password/verification codes, not sharing login data with any unauthorized party, and immediately notifying the school or support upon suspecting any unauthorized use.
- The school (in coordination with Moazez when necessary) has the right to reset passwords, suspend accounts, or cancel them according to policies.
5) Acceptable Use Policy
You agree not to do the following:
- Use the platform for any non-educational/operational purpose related to the school.
- Misuse the platform, attempt to disrupt it, or circumvent its permissions.
- Unauthorized access to the accounts or data of others.
- Enter or publish content that violates regulations, public morals, or the rights of others.
- Send spam, fraudulent, or threatening messages through the platform.
- Upload malicious software or conduct penetration testing without written permission.
- Attempt mass data extraction (Scraping), copy databases, or reverse engineer the platform.
6) Services and Features
The "Moazez" platform may include – depending on the school's package and activation – the following:
- Behavior and motivation management (points/rewards/levels).
- Dashboard, statistics, and key performance indicators (KPIs/BI).
- Applications for different roles (Student/Parent/Teacher/Admin).
- The "Summon/Dismissal" features to organize student exit.
- Skills/Tasks Market and school economy (if activated).
- Integrations with external systems/providers (e.g., messaging/payments).
Features may change, be updated, or added according to the product roadmap, while maintaining the core of the service contracted with the school.
7) Summon/Dismissal and Verification
- If the school activates the summon/handover feature, verification mechanisms may be used (such as a verification code, location tracking, or biometric verification depending on settings).
- The responsibility for field operations (such as gate procedures and who is authorized to pick up) falls on the school, and the platform is an organizing and support tool.
- The user must adhere to the school's instructions inside and outside the system, and any violation may result in restricted access.
8) Skills Market and Escrow (If feature is activated)
If the school provides the "Skills/Tasks Market" feature:
- The feature may include an Escrow mechanism to hold the value (points/amounts/balance) until the task is completed according to specific conditions.
- Rules are defined for: accepting the task, completion criteria, execution duration, and the approval/review mechanism.
- The user is responsible for the accuracy of the outputs provided within the task.
- The school/supervisors have the right to approve or reject the completion according to the standards published within the system.
- Any dispute related to the task is managed according to the complaint/review mechanism approved by the school and using the records provided by the platform.
Note: If there are actual financial payments and not just points, additional terms specific to billing/payment and the payment provider apply.
9) Messages and Notifications
- You may receive in-app notifications, emails, or SMS messages depending on what the school has activated and based on the registered contact data.
- You are responsible for updating your mobile number/email (via the school or the platform's mechanism).
10) Content and Usage Rights within the Platform
1. School and User Content:
The school is responsible for the content it inputs (lists, behavior policies, messages...). The user is responsible for any content they send within their permissions.
2. Operating License:
The school and users grant "Moazez" a limited right to process, operate, and display the content within the platform solely to provide the service.
3. Prohibited Content:
It is prohibited to input any content that violates intellectual property rights, privacy, or regulations.
11) Intellectual Property
- All intellectual property rights related to the "Moazez" platform (software, design, logos, interfaces, operating rules...) belong to [Moazez] or its licensors.
- It is not permissible to copy, resell, lease, or create derivative works of the platform without written permission.
12) Analytics and Artificial Intelligence
- The platform may use analytics or AI models to provide assisting indicators (e.g., behavioral patterns, early warnings, educational recommendations).
- These indicators are supportive and do not constitute a final decision; they must undergo human review within the school before any substantial action.
- The school is committed to using these indicators responsibly and in compliance with its policies and regulations.
13) Integrations and External Services
- Some features may rely on external providers (messaging, payments, hosting, analytics...).
- "Moazez" is not responsible for outages of a third-party provider beyond its control, and we will strive to coordinate to mitigate the impact as much as possible.
14) Suspension/Termination
The school or "Moazez" (as applicable) may suspend or restrict access to the platform if:
- A violation of these terms or school policies occurs.
- There is suspicion of harmful/fraudulent behavior or hacking.
- Required by a regulatory obligation or an order from a competent authority.
- It is necessary to protect the security of the platform and users.
Upon suspension, the user may lose access to some or all features according to the school's/administration's decision.
15) Service Availability and Maintenance
- The service may be temporarily suspended due to scheduled maintenance, updates, or emergency circumstances.
- We will work to minimize downtime and notify the school during major maintenance whenever possible.
- We do not guarantee that the service will be 100% uninterrupted, but we commit to exercising reasonable professional care to operate it.
16) Disclaimer
- The service is provided "as is" and "as available" within the limits permitted by regulations.
- "Moazez" does not guarantee specific educational/behavioral outcomes; results depend on the school's application of policies and procedures and users' cooperation.
- "Moazez" is not responsible for users' actions or the school's administrative/educational decisions made based on platform data or indicators without appropriate human review.
17) Limitation of Liability
To the extent permitted by regulations:
- "Moazez" bears no responsibility for any indirect or consequential damages (such as loss of profits/reputation/data) resulting from the use or inability to use the platform.
- The total liability of "Moazez" – if proven – shall be within the limits of the fees paid to the school during the [duration/e.g., 12 months] preceding the cause of the claim, unless prohibited by regulations.
18) Compliance with Regulations
- Both parties commit to the applicable regulations in the Kingdom of Saudi Arabia, including data protection laws, cybercrime laws, and education-related regulations.
- The user commits to using the platform in a manner that does not violate regulations or school instructions.
19) Amendments to the Terms
We may update these terms from time to time. The updated version will be published with the date of the last update.
If the changes are material, we will notify the school appropriately, and continued use after the update takes effect constitutes acceptance of it.
20) Governing Law and Dispute Resolution
- These terms are governed by the laws and regulations of the Kingdom of Saudi Arabia.
- Any dispute shall be resolved – as much as possible – amicably through the school first (for users), then through official channels between the school and "Moazez".
- In case an amicable solution is not reached, the judicial authority/jurisdiction shall be as stipulated in the school's contract or applicable regulations.
